General Duties of Drivers & Passengers
Seating
A driver of a vehicle must be seated in such manner as to maintain full control of the vehicle and have a clear and unobstructive view of the road ahead.
Reversing a Vehicle
A driver may not reverse a vehicle for further than is reasonably necessary. There is no specified legal distance though.
Following Another Vehicle
A driver may not follow another vehicle too closely in relation to speed and traffic conditions.
Interfering Passengers or Animals
A driver may not allow a passenger or animal to interfere with the control of the vehicle, or his or her ability to indicate intentions to stop, slow down or turn.
Another Person Steering
A driver may not allow a passenger to steer the vehicle, unless the driver him or herself becomes incapacitated to do so.
Leaving a Vehicle Unattended
A driver may not leave a vehicle unattended without setting the parking brake or using another method to prevent the vehicle from moving.
Sticking Any Body Part Out of a Window
A driver may not allow a passenger or him/herself to stick out any part of the body through a window, unless this is done to give hand signals when operating the vehicle.
Excessive Noise or Smoke
A driver must not run the vehicle’s engine when it is giving off excessive noise or smoke.
Filling Up with Petrol or Diesel
A driver must not run the vehicle’s engine when filling the tank with petrol or diesel.
Running Engine and Leaving the Vehicle
A driver must never keep a vehicles engine running when leaving the vehicle unattended.
Leaking Fuel, Oil or Grease
A driver must not operate a vehicle that is depositing fuel, grease, oil, any other flammable or offensive matter, or refuse of any nature onto the road or alongside the road.
Fuel Cap
A driver may not operate a vehicle that does not have a closed fuel cap.
Passengers and Moving Vehicles
A driver must never allow any passenger to get on or off a moving vehicle.
Pavements and Sidewalks
A driver may not drive, push or pull a vehicle on any pavement or sidewalk.
Emergency Vehicles
A driver must always give way to a vehicle sounding an emergency siren, move out of its way and allow it to proceed.
Communication Devices
No driver may operate any communication device, like a cellphone or two-way radio while driving a vehicle. This must be done through hand-free or head sets.
Drivers' or Learner License
A driver of a vehicle must always have a valid driver’s license card, learner license or temporary license in his or her possession or within the vehicle that is being driven.
